Crowhill Residents Defy High Court Order In Borrowdale Road Dispute

Crowhill residents have been accused of defying a Court order in their road dispute with Mt Breezes residents.

The order was delivered in favour of Mt Breezes Borrowdale Residents Association by Justice Musithu in 2020.

It stated that that there is no authorized public road interlinking any portion of Mt Breezes and Crowhill.

However, Crowhill residents argue that humanity must prevail over commerce and the road must be opened.

Speaking on the contentious issue legislator Ozias Bvute said the road is illegal.

“Residents must uphold the Court ruling as we look for a way to find each other in addressing this issue.

“First, lets uphold the court ruling”.

The contested road is allegedly illegal and does not appear in any official Surveyor General or local authority plans.

Humanity Over Commerce

Crowhill residents have however been using it for years until recently when the new gated community blocked it.

The move, by the roughly 70 Mt Breezes residents, has however disadvantaged over 2000 Crowhill residents.

“The road constructed by Crowhill Properties Owners Association, purportedly linking or seeking to link with Mt Breezes through stand 32 is an illegal and unlawful interference with the enjoyment of rights of the private development scheme” he said.

Crowhill residents have since come up with a petition on the matter which they intend to present to Harare Council.

“As residents of Crowhill Views, we are affected by the unjust blockage of the public road that provides access to our properties. 

“This barricade, enforced by the Mt Breezes Association, is causing immense distress for over 2,000 households.

“The road is a vital link for the residents to reach their homes and its blockage is denying us our rights to freely move and live in peace within our private properties. 

Currently the petition has received 750 signatures.
