Developer Drags Council To Court Over 10 Year Old Saga

Land developer Swandev has filed an urgent application against Marondera Municipality to stop it from parceling out stands at Elmswood.

“Take notice that the application hereby makes a chamber application for a spoiliation order in terms of the order annexed to this application.

“On the 10th of October the respondent forcibly disposed the applicant of its land namely Lot 1 of Elmswood farm.

“(This was done) by illegally settling its members and creating makeshift structure without following due process,” it says.

However, Council Public Relations Officer Kudakwashe Tapfumaneyi could not deny nor confirm the development.

“I will update you once I get enough information from my bosses at the moment were not around,” he said.

The two parties have been locked in a dispute over a decade with several meetings ending in deadlock.

In 2015, thousands of home seekers were made to pay various amounts between USD500 and USD1500 for residential stands.

The money was paid at council offices with the local authority saying the homeseekers were to be allocated land at Elmswood.

However, up to now the stands have not been allocated after it emerged that the land belongs to Swandev.

A group of disgruntled beneficiaries have since dragged Council to court.

In its defence Council argues that it doesn’t own the land.

In July the Ministry of Local Government ordered Council to expedite the servicing of Elmswood farms stands.
